The Gimme More singer is due in court for the first custody hearing since she was stripped of her visitations rights to Sean Preston, two and 16-month-old Jayden James after refusing to hand them back to ex-husband Kevin Federline two weeks ago.

Kevin’s lawyer Mark Vincent Kaplan reportedly plans to ask Commissioner Scott M. Gordon, who is overseeing the custody battle, to prevent Britney having any access to her children until April.

Kaplan said: “Britney will have the opportunity to persuade the court that she can have some visitation under monitored conditions.

“The emergency court orders granting sole physical and legal custody to my client are only temporary. These are very, very draconian orders. Because of that the court wanted to have a hearing to give her and her attorneys the opportunity to refute some of the declarations.”

Kevin was granted full custody of the boys in October when Britney, 26, failed to attend a court-ordered drugs test. Until last Friday (04.01.08), Britney had three supervised visits with her sons, including one overnight stay, a week.

Her visitation rights were removed in an emergency court hearing after she was hospitalised for a psychiatric evaluation following a three-hour stand-off with police at her Beverly Hills home when she refused to hand her kids back to Kevin.

The police and emergency service personnel involved in the altercation are due to give evidence in court. Britney left Los Angeles’ Cedars-Sinai Medical Center a day after being admitted.
