Kiefer Sutherland faces jail after he was charged with DUI (driving under the influence) on Friday (28.09.07).

The ’24’ star – who was charged with two misdemeanour counts of DUI following his arrest on September 25 – could receive a prison sentence due to a previous DUI conviction from November 2004.

City Attorney Office spokesman Nick Velasquez said: “We have charged Mr. Sutherland with a second DUI offence within 10 years, which we believe also constitutes a violation of the terms of his probation from his 2004 conviction.

“Since he is still on probation from this 2004 DUI, we have also requested that the court revoke his probation and set a probation-violation hearing.”

Sutherland was sentenced to 60 months’ probation, 50 hours of community service and an alcohol-treatment programme in 2004. He completed the community service and treatment in 2005.

Sutherland’s publicist Evelyn Karamanos said after his arrest last week: “It would be premature to comment at this time.”

The 40-year-old action star has since returned to the set of ’24’, which is scheduled to air in the US in January.

Sutherland’s arraignment is set for October 16, but he is not required to appear in court.
