The East End comic didn’t sign a pre-nuptial agreement with the Firework singer so is legally entitled to half her $44 million fortune.

However, Russell has told Katy he doesn’t want anything from her and wants their split to be as amicable as possible.

According to TMZ.com, their divorce will become official on 30 June because there is a six month waiting period.

It was recently reported Russell – who was famed for his womanising ways before he met Katy – had started dating again and was seeing more than one woman.

Sources said Katy had been told that her estranged husband – who has previously been treated for sex addiction and substance abuse issues – had moved on from their marriage by her pals.

One said: “She discovered through her friends. One of the women told a friend of hers and it got back to Katy.”

Meanwhile, Brand has been lined up to play Wurzel Gummidge in a movie version of the 70s kids’ TV show.
